Justice HS Bedi to head Fake Encounter investigation

The Supreme Court today appointed Justice HS Bedi as chairman of a monitoring authority, looking into the investigations of 22 encounter killings in Gujarat during 2002-06. Justice Bedi is a retired judge of the Supreme Court.

The court rejected the Gujarat government's plea for more time to persuade Justice M.B. Shah not to step down as chairman of the monitoring authority. The court said that it wanted the supervision and monitoring of the investigation in the cases should be done by someone whose integrity is completely beyond any question.

The bench comprising justices Aftab Alam and Ranjana Prakash Desai said "We, accordingly, deem it fit to request Justice Bedi to head and monitor the investigation of the cases of alleged fake encounter enumerated in the writ petitions."

The Gujarat government had earlier drawn flack from the Supreme Court for the appointment of former Bombay High Court Chief Justice K.R. Vayas to the post without its consultation. The court had rejected the name of Justice K R Vyas for the post.

The bench is hearing PILs filed by journalist B G Verghese and lyricist Javed Akhtar, who had sought a direction for a probe by an independent agency or the CBI so that the "truth may come out".

Justice K R Vyas had previously been the chairman of Maharashtra Human Rights Commission and in 2006 his name was proposed by Gujarat CM Narendra Modi for the post of Lokayukta in Gujarat which was rejected by the Governor.
