Guv to take final call on prosecuting Purushottam Solanki: HC

The Gujarat High Court has set up the scene for another high voltage encounter between the Modi government and Guv Dr Kamla Beniwal. Dismissing the contempt petition filed against the state cabinet the HC has left the final decision on fisheries minister Purushottam Solanki’s prosecution to the Governor.

The Modi govt. had refused to give sanction for the prosecution of fisheries minister Purushottam Solanki in an Rs400 crore fishing contract scam. Following this, complainant in the case Ishaq Maradia filed a petition in the Gujarat high court seeking contempt proceedings against Modi and the state cabinet.

The Gujarat high court, on Friday, dismissed the contempt petition filed against the state cabinet but left a final decision on Solanki’s prosecution to the Governor. The court observed that, “prima facie, no case of contempt has been made out.” However, the court said: “Final power rests with the governor, and the chief secretary shall forward all documents to the governor within one week.” 

While issuing the order, the bench also directed that the names of Modi and eight cabinet ministers be deleted from the list of respondents in the contempt petition. The bench of justices Jayant Patel and CL Soni asked the chief secretary to forward the decision and final opinion of the state council of ministers to the governor within a week. Following this, the governor has to take a final decision in the matter within two weeks.

The case will now come up for hearing on July 30.
