Accused Cops challenge Danta Court’s Jusridiction

Four police officers who have been named as accused in the Tulsiram Prajapati encounter case have moved to Gujarat High Court challenging the Danta magisterial court’s jurisdiction over the chargesheet filed by the CBI.

Former director general of police (DGP) P C Pande, additional DGP Geetha Johri, DSP R K Patel and suspended SP Rajkumar Pandian have filed petitions in the Gujarat HC challenging judicial magistrate Geeta Ahir’s order to accept the chargesheet filed by the CBI.

Last week, the CBI had argued that as the offence had taken place in Danta court’s jurisdiction and earlier probe agency CID (crime) too had filed two reports with the same court, the Danta court is authorized to act upon the probe report.The court had found merit in the CBI’s argument and had concluded that it is competent to take cognizance of the chargesheet filed by CBI.

The accused cops’ counsel has argued that courts cannot take cognizance of offence against cops and public functionaries without mandatory sanction obtained by the prosecuting agency from the state government under section 197 of the CrPC. The petitions are expected to come up for hearing next Monday before a single-judge bench.
