Lawyer files PIL against lawyers in Gujarat HC

In a bizarre turn of events, a layer has filed a PIL against fellow lawyers in the Gujarat High Court.  

Advocate Amit Panchal filed a PIL demanding action against lawyers, who allegedly abused and manhandled an advocate on HC premises for appearing before the court on Monday, when the lawyers were on strike. 

On Monday, the Bar Council of India requested all bar associations across the country to abstain from work to protest police assault on lawyers in Jaipur and Chandigarh. As part of this strike, the members of Gujarat High Court Advocates’ Association (GHAA) were also restraining lawyers from conducting cases.

When they came to know that one lawyer conducted a case before Justice R H Shukla, they allegedly barged in his chamber, abused and physically assaulted him before his office staff.

The lawyer complained before Chief Justice Bhaskar Bhattacharya demanding action against striking lawyers, who indulged in his manhandling, as per the provisions of a Supreme Court order by which it termed the strike “illegal”. 

The PIL has also demanded directions to lawyers’ associations and bars to formulate rules to govern advocates’ conduct during strikes or protests. 

The bench of Chief Justice Bhaskar Bhattacharya and Justice J B Pardiwala, however, recused itself from hearing the case on Wednesday. The PIL may now be heard by some other bench. 

“President and other office bearers of GHAA, who are meant to protect the interest of their members like me, were only silent spectators and their behaviour and attitude reflected the tacit consent and abetment to the verbal and physical assault on me,” the lawyer complained.

The PIL has demanded action against all those responsible for the incident by way of enforcing the strike, which is prohibitory for those in legal profession so far as the apex court’s verdict is concerned. The PIL has sought to the BCI, Bar Council of Gujarat and GHAA to come up with a notification or resolution to maintain proper conduct and discipline among lawyers.
