Governor to appoint GU VC search committee: HC

The Gujarat HC has dealt a blow to the state government by giving the Governor the liberty to appoint a Search Committee to scrutinize the names proposed for the post of Gujarat University vice-chancellor.
The HC passed the interim order acting on a petition filed by one Dhaval Patel, challenging the setting up of recent search committee saying that it was in violation of provisions made by the University Grants Commission Act and Regulations of 2010.
In the light of the court order, the current Search Committee appointed by the state government will become defunct once the Governor acts on the court order. In his petition, Patel has contended that the present committee has been formed under the Gujarat University Act, but the provision made to constitute the search committee in this legislation is ultra vires to provisions of the UGC Act.
The state govt. appointed committee comprises of advocate Saurabh Amin who was nominated by the chancellor, Y P Singh appointed by the Central and Academic Council of Gujarat University and Dr Kamlesh Joshipura who was appointed from the joint board of VCs.
Patel submitted that as per provisions of Clause 7.3 of the UGC Act, the search committee is to be constituted by the chancellor’s (governor of Gujarat) nominee as chairperson. Another person should be a nominee of the chairman of the UGC and the third person has to be nominated by the executive council and academic council of the university. This committee has to suggest names and the chancellor can select one name from the panel for appointment as VC.
The bench of acting chief justice Bhaskar Bhattacharya and Justice JB Pardiwala observed that, prima facie, the petitioner had a strong case. “The respondents, including the Chancellor, may appoint the V-C as per the clause 7.3 of the UGC Act,” the bench said.
