Additional DGP P P Pande who surrendered before CBI court this morning was later remanded to judicial custody till August 27. Pande who was declared absconder by the CBI had no way left but to surrender as Supreme Court had on Monday rejected his plea for anticipatory bail.
Additional Chief Metropolitan Magistrate H S Khutvad ordered 14-day judicial custody for Pande, who has been named as one of the main accused by the CBI in its chargesheet in Ishrat encounter case of 2004. The CBI has sought 14-day
remand of Pandey.
Quoting section 197 of CrPC Advocate of Pande had contended that CBI could not arrest him as his being government officer prior permission of the government was necessary for his arrest. This was countered by the CBI. The Court has to give its judgment on this issue.
In its charge sheet filed on July 3, the CBI had said that it was a joint operation between the Gujarat police and the Intelligence Bureau. Pande has been charged with conspiracy, illegal custody, kidnapping and murder in the charge sheet.
After gunning down Ishrat Jahan, Javed Shaikh alias Pranesh Pillai, Zeeshan Johar and Amjad Ali Rana on the outskirts of Ahmedabad on June 15, 2004, the Gujarat police had claimed that they were Laskher-e-Toiba agents out to kill Chief Minister Narendra Modi.
