Additional Director General of Police P P Pandey who surrendered in the CBI court earlier has now been remanded to CBI custody till August 21. He is said to be the main accused in the much publicized Ishrat Jahan fake encounter case of 2004.
Pandey was avoiding arrest and he was declared absconder by a CBI court. He tried all imaginable legal means to stay out of CBI clutches. He is the senior most officers who has been arrested in the case in which Ishrat Jahan and three others were killed by Gujarat police.
After his surrender on August 13, PP Pandey was sent to judicial custody till August 27. Additional Chief Metropolitan Magistrate H S Khutvad ordered 14-day judicial custody for Pandey. The CBI had sought 14-day remand of Pandey.
Quoting section 197 of CrPC Advocate of Pandey had contended that CBI could not arrest him as his being government officer prior permission of the government was necessary for his arrest. This was countered by the CBI. The Court, however, later rejected this plea.
In its charge sheet filed on July 3, the CBI had said that it was a joint operation between the Gujarat police and the Intelligence Bureau. Pande has been charged with conspiracy, illegal custody, kidnapping and murder in the charge sheet.
After gunning down Ishrat Jahan, Javed Shaikh alias Pranesh Pillai, Zeeshan Johar and Amjad Ali Rana on the outskirts of Ahmedabad on June 15, 2004, the Gujarat police had claimed that they were Laskher-e-Toiba agents out to kill Chief Minister Narendra Modi.
