In a significant judgement the Gujarat High Court today ruled that candidates applying in reserved category in government jobs cannot be selected in general category. It further clarified that those who have taken advantage of exemption in age limit in reserved category cannot opt for general category.
This judgement will provide a great relief to about 91 candidates who were selected for class 3 and 4 by Gujarat State Public Service Commission (GPSC). The candidates had cleared exams and interviews for the post of deputy mamlatdar and civil section officer. But they were not given appointment as the matter was in court.
In this case a few of reserved category candidates applied for posting in general one. This had led to wide spread protests as the reserved ones were vacant and carried forward. A division bench of Justice M R Shah and Justice G R Ujwani rejected the decision of a single judge who had ruled that SC-ST candidates can get job in general category.
GPSC had appealed against the order. It said that the court had not heard the affected 91 candidates and had neither taken government’s policy of 1986 regarding this into account.
